Terms and Conditions relating to Sneak Energy

sneakenergy.com UK Limited of Queens House 4th Floor, 32/34 Queen Street, Manchester, M2 5HT is the promoter of the competition (“Promoter“).

1.   Eligibility

○   This Prize Draw is open to individuals in the UK only, aged over 18 years or over, except for employees of the Promoter, their immediate family, sponsors of the Prize Draw and their employees who are directly associated with the administration of the Prize Draw.

○   Prize winners must both be aged 18 and over, at least one traveller must be aged 21 or over. The Promoter reserves the right to obtain proof of such consent and to refuse entry or to choose another winner if such proof, where requested, has not been given.

○   The prize winner must confirm proof of purchase with the promotion product packaging & purchase receipt.

 

2.  The Competition

○   The title of the competition is Sneak Energy© Daredevil Born Again© Giveaway

 

3.  How to enter

○   To enter the Prize Draw entrants must:

■   Scan the QR Code on a can of Sneak Energy©  Daredevil Born Again©  Can or Tub (“Promotional Pack”) 

■   Entrant MUST submit the below details for their entry to be valid:

●   First Name

●   Last Name

●   Email Address

●   Confirm Email Address

●   Mobile Number

●   Date of Birth

■   Entrant has the option to opt in to receiving marketing communications

■   Entrant MUST confirm that they’re 18 and over

■   Entrant MUST acknowledge that they’ve read the Terms and Conditions

○   Entries must be made between 00:01 16/02/2026 - 23:59 31/05/2026 to be valid. (“Prize Draw Period”)

○   Entries received after the end of the Prize Draw Period will not be valid.

○   Only one entry per entrant will be valid.

○   No bulk, third party or automated entries are permitted.

○   All entrants (including the winner) must comply with any reasonable directions given to him or her by the Promoter in connection with the Prize Draw. Failure to comply with such directions may result in an invalid Entry and/or withdrawal of the Prize.

 

4. Winner selection and contact

○   The winner of the Prize Draw will be announced via email no later than 15/06/2025 (“Announcement Date”).

○   The  winner will be contacted personally by Element London as soon as practicable after the Announcement Date, using the email address/contact number provided with the competition entry. The Promoter will ask the Winner to provide further details in relation to the Prize (the “Details”). The Winner must provide the Details in order to claim the Prize.

○   If any Winner fails to provide their Details to the Promoter within 7 days of the Promoter contacting the winner and asking them to provide the Details in accordance with clause 4.2 and then the Promoter acting in its absolute discretion may:

■   make further attempts to contact that Winner; and/or

■   withdraw the Prize from that Winner.

○   If the Prize is declined by a Winner or is withdrawn from a Winner by the Promoter, the declining or forfeiting Winner will continue to be subject to the provisions of these Terms and Conditions; and the Promoter may offer the Prize to a new Winner by random selection in accordance with this clause 4.2.

 

5. Prize

○   The prize is inclusive of a trip for two adults to New York, USA, in accordance with clause 10.1 to 10.32, and limited to:

■   Roundtrip economy / coach flights from select major international airports in the UK to New York City, USA.

■   Transfers: Roundtrip airport transfers in New York City, USA

■   Accommodation: 5 nights’ luxury (4* min) hotel accommodation in New York City, New York.

■   Daily Breakfast

■   Private Super Hero-Inspired Stunts And Martial Arts Masterclass: (1 hour) Includes professional instructor and all equipment

■   Private True Crime Tour With A Lawyer And True Crime Historian: (2 hours) Includes private tour guide

■   Sensory Immersive Art Experience : (Allow 1-1.15 hours) Includes general admission

■   Crime-Themed Escape Room: (1 hour)

■   Immersive Observation Deck Experience In NYC Skyscraper

■   Dinner At A Rooftop Restaurant In Hell’s Kitchen: Provided to the value of $100 USD per person

■   Travel Insurance Allowance: Provided to the value of $75 USD per adult

■   Full Winner Management From Element: Including translation of winner correspondence and travel documents where required

○   For the avoidance of doubt, the Prize does not include anything outside of the above.

○   The Winner shall be responsible for adhering to any COVID guidelines and social distancing measures when redeeming the Prize. The Promoter shall not be liable if the Prize cannot be redeemed due to COVID. {IF APPLICABLE}

○   The Prize is non-transferable and non-refundable, and the Winners cannot request any alternative prize (cash or otherwise).

○   The prize is valid for 12 months from the date of notification and all travel must be completed within that time.

○   There will be 1 winner announced.

 

6. Winner publicity

○   The Promoter reserves the right to publish each Winner’s name and Entry on the Promoter’s official social media accounts, including Twitter, Instagram and Facebook and on its website found at  www.sneakenergy.com

○   By entering the Prize Draw, if you are a Winner you agree to your Entry being published in accordance with clause 7.1 and to take part in and cooperate fully with all reasonable publicity accompanying or resulting from this Prize Draw without further recompense.

 

7.  Entry requirements

○   Any Entry that is deemed by the Promoter, in its sole discretion, to be unlawful, obscene, vulgar, pornographic, hateful, threatening, discriminatory, offensive or which may otherwise bring the Prize Draw or Promoter into disrepute will be excluded from the Prize Draw and the Promoter reserves the right to take any further action in respect of such Entry that it deems appropriate.

○   The Promoter will fully cooperate with any law enforcement authorities or court order requesting or directing the Promoter to disclose the identity of or to locate anyone posting or linking any content to its Twitter or Instagram pages which infringes any third party rights or is in breach of any of these Terms and Conditions or any applicable law.

 

8. Liability

○   Except for death or personal injury caused by negligence of the Promoter or its agents or representatives or for fraud or fraudulent misrepresentation, neither the Promoter, nor its agents or representatives assume responsibility for:

■   any Prize that is not redeemed;

■   any personal property;

■   any loss of enjoyment or wasted expenditure;

■   any system failures or malfunctions of any third party websites;

■   any incomplete, lost, delayed or late Entries;

■   any failure to fulfil obligations of any third parties involved in this Prize Draw;

■   any fault, malfunction, damage, loss or disappointment suffered by the participants in the Prize Draw howsoever arising from participating in the Prize Draw;

■   communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Prize Draw;

■   inaccessibility or unavailability of the internet, or any website (including without limitation any social media websites) or any combination thereof through dial up, broadband, mobile internet or WAP connections;

■   any injury or damage to a participant which may be related to or arising from the Prize Draw or the Prize;

■   if for any reason the Prize Draw or any website in connection with the Prize Draw is not capable of running as planned for reasons which may include without limitation, infection by computer, virus, tampering, unauthorised intervention, fraud, technical failures or any other causes which may corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion; and/or

■   any other matter outside of their reasonable control.

○   Nothing in these Terms and Conditions affects your statutory rights.

○   To the extent permitted by law, all conditions, warranties and other terms which might otherwise be implied by statute or common law are expressly excluded from these Terms and Conditions.

○   The Winners agree to indemnify and keep indemnified the Promoter, its group of companies and their officers, employees and agents from and against all liabilities, losses, damages and expenses (including legal and other professional fees) arising out of or in connection with any allegations or claims resulting directly or indirectly from:

■   their Entry into this Prize Draw; and/or

■   their receipt and use of any Prize.

 

9. General

○   The Promoter reserves the right to cancel or amend the Prize Draw or these Terms and Conditions if it has reasonable grounds for doing so. Any changes to the Prize Draw or these Terms and Conditions will be announced by the Promoter through its Instagram accounts. 

○   By entering the Prize Draw you accept these Terms and Conditions as in force at the time you submit your Entry.

○   Any person who provides their Details to the Promoter in connection with this Prize Draw accepts:

■   these Terms and Conditions; and

■   the use of their personal data by the Promoter:

■   for the purpose of administration of the Prize Draw (including publishing the names of the Winners and any administration relating to the Prize); and

■   any other purpose for which they have consented.

○   The use of any personal data by the Promoter shall be in accordance with the Promoter’s Privacy Policy which can be found on the Promoter’s website at www.sneakenergy.com

○   The Promoter reserves the right to exclude any Entry from the Prize Draw if it deems it to be ineligible or otherwise invalid and the Promoter shall have complete discretion in this respect.

○   No responsibility can be accepted for lost Entries or incomplete Entries. Proof of Entry is not proof of receipt.

○   If any provision of these Terms and Conditions (or part of any provision) is found by any court or other competent authority to be invalid, unenforceable or illegal, the other provisions shall remain in force.

○   If any invalid, unenforceable or illegal provision would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the commercial intention of the Promoter.

○   No failure or delay by a party to exercise any right or remedy provided under these Terms and Conditions or by law or any abandonment of any such right or remedy shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy.

○   No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

 

10. Element London Terms and Conditions

○   Winner and guests must be aged 18 or over; At least one traveler must be aged 21 or over;

○   Roundtrip economy / coach flights (inclusive of all applicable airport taxes, fees, and duties) from select major international airports in the country where the recipients all reside to New York City, USA flights may be indirect and not all routings will be available, flight itinerary will be determined by prize provider at their sole discretion;

○   Accommodation is for 5 nights, based on one double occupancy room for two adults, in a 4* hotel with breakfast in New York City, USA;

○   The trip must include a Saturday night stay;

○   Accommodations do not include any other meals, incidentals, gratuities, telephone calls, or any other personal expenses incurred during the trip, will be the responsibility of the Recipients;

○   A credit or debit card for incidentals may be requested by the hotel at check in and therefore at least one of the Recipients must possess and travel with a valid credit or debit card;

○   Accommodations will be selected by Element London Ltd at their sole discretion;

○   Prize Package is for up to 2 adults, all of whom must travel at the same time with the same itinerary;

○   Prize is valid for 12 months from the date of notification and all travel must be completed within that time;

○   Winners must contact prize provider with three preferred travel dates in three separate months no later than six weeks prior to departure;

○   Prize cannot be taken over Christmas, New Year or Public Holidays in the prize package destination or the country of departure;

○   All recipients must be in possession of a valid passport for the duration of the trip. Non-European Union passport holders may be required to have passport validity for six months beyond the duration of the trip. All recipients are responsible for obtaining any other documentation required for travel to and entry to the prize package destination; All travelers will require a passport valid for at least 6 months on date of travel;

○   Any necessary visas or insurance are the responsibility of the winner and guests;

○   A $75 USD cash allowance per adult will be provided for winner and guests to purchase travel insurance;

○   The prize excludes domestic ground transfers, rental car, meals and drinks, excursions, attractions, treatments, visas, personal expenses and anything not expressly stated in the prize package;

○   Prize is non-refundable and non-transferable; No cash alternative is available;

○   Prize is subject to availability;

○   Winner travels at own risk. Promoter reserves the right to cancel, modify, suspend or terminate the promotion or prize;

○   Where applicable, any modifications to the prize will be at the winner's own expense;

○   The prize package inclusions are subject to availability, where any of the stated inclusions are unavailable, Element London Ltd will offer suitable alternatives of equal value;

○   If winner is unable to participate in any of the stated activities, then Element London Ltd will offer suitable alternatives of equal value, alternative activities will be determined by prize provider at their sole discretion;

○   The stunt masterclass will be tailored to participant’s abilities, participants should be in good physical health;

○   The true crime tour of NYC is not suitable for travelers with heart problems or other serious medical conditions;

○   The minimum age for the escape room experience is 10 years;

○   Dinner at the specified restaurant is provided to the value of $100 USD per person, including tax and gratuity;

○   Children must be accompanied by a supervising adult at all times on all tours and experiences;

○   All tours and experiences will be conducted in English;

○   All cash allowances will be converted into the winner’s local currency and transferred into one nominated bank account;

○   Nothing in this travel package authorizes any person to use the Walt Disney Company's and its affiliated companies (collectively, "Disney") name, brand, intellectual property, characters or reputation in conjunction with this travel package or any prize promotions whatsoever and that a valid promotional agreement with Disney is a precondition for use of this prize package in association with Disney's name or Disney-owned intellectual property;

○   The Walt Disney Company, and each of their respective parent, affiliates, and subsidiaries are not responsible for the promotion, administration or execution of the travel package, competition, contest or sweepstakes;

○   The Walt Disney Company is not a so-called “sponsor,” “administrator” or “prize provider. ”The Walt Disney Company, its parent, related, affiliated and subsidiary entities and their respective officers, directors, agents, employees and assigns shall be released and discharged from any and all legal claims, losses, injuries, illnesses, demands, damages, actions, and/or causes of actions that arise out of and/or are in any way related to the prize travel package, the receipt, use and/or enjoyment of the prize travel package, or prize- related activity including, without limitation, travel, the promotion, the competition, the contest or the sweepstakes.

The Prize Draw, these Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim which may arise out of or in connection with the Prize Draw or these terms.
